GSTAT appeals: what happens after you file
Once a GSTAT appeal is filed, it goes through scrutiny by the registry, registration, listing and then hearing before a bench. The pre-deposit proof, the full record of the lower proceedings and the written submissions should be ready before the first listing.
Where the Tribunal fits
The GST Appellate Tribunal hears second appeals under Section 112 of the CGST Act against orders of the First Appellate Authority (Section 107) or the Revisional Authority (Section 108). It became operational in September 2025, with 31 state benches and a Principal Bench in New Delhi.1
The filing deadline
For older orders, the government set a transitional last date of 31 July 2026 for appellate orders communicated before 1 May 2026.2 Later orders follow the normal limitation: three months from the date the order is communicated.
About 30,000 appeals were filed in the last 15 days before that date, with up to 5,500 a day.1 Many of those appeals are now moving to hearing.
After filing
- Scrutiny. The registry checks the appeal papers. Defects must be cured within the time allowed.
- Registration and listing. Most appeals are heard by one Judicial Member and one Technical Member.3
- Admission. The Tribunal can decline to admit an appeal where the amount involved is ₹50,000 or less.3
- Hearing. Arguments on facts and law, followed by the order.
Pre-deposit
An appeal to the Tribunal requires payment of the admitted amount in full and a further percentage of the remaining disputed tax, over and above the deposit made for the first appeal. The percentage and cap are set in Section 112(8).
If the Tribunal rules against the taxpayer
An appeal lies to the High Court under Section 117 within 180 days, where the case involves a substantial question of law.

Possession delayed? Refund or interest under RERA
When a builder misses the possession date in the agreement, Section 18 of the RERA Act gives the allottee two choices: withdraw and claim a refund with interest, or stay and claim interest for every month of delay until possession.
The two options
- Withdraw. The promoter must return the amount paid, with interest at the prescribed rate, and compensation where applicable.
- Stay in the project. The promoter must pay interest for every month of delay until possession is handed over.
Where complaints are heard in the NCR
Complaints are filed online with UP RERA under Section 31. About three in four UP RERA complaints come from the NCR, and the Authority hears them at its regional office in Greater Noida.1 Compensation claims go to the adjudicating officer under Section 71.
Enforcement and appeals
If the promoter does not comply, the Authority can issue a recovery certificate, and the amount is recovered as arrears of land revenue under Section 40. Appeals go to the UP Real Estate Appellate Tribunal within 60 days (Section 44), and then to the High Court within 60 days (Section 58).
